Rhythm — Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rhythm application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Rhythm is a marketplace for daily routines. Creators publish structured routines — a sequence of time blocks (time, duration, and type, with optional text, video, and web links) for a day or several days. Users can browse, purchase or save routines, and follow them with timed reminders and check-ins. The Service is provided "as is" and may change over time.

2. Eligibility & Accounts

• You must be at least 13 years old (or 16 in some EEA countries) to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information when creating an account.
• You may delete your account at any time from Settings → Delete Account. Account deletion is irreversible and removes your account and associated content and activity as described in our Privacy Policy.

3. Creator Content & License

• You retain ownership of the content you create. By publishing a routine, you grant Rhythm a non-exclusive, worldwide, royalty-free license to host, display, distribute, and promote that routine within the Service.
• You represent and warrant that you own or have the necessary rights to all content you publish, and that your content does not infringe the rights of any third party.
• You are solely responsible for the content you publish. Rhythm may remove content that violates these Terms or applicable law.
• Routines are licensed to buyers for personal use. Buyers may not resell, redistribute, or re-publish a routine outside the Service without the creator's permission.

4. Purchases & Payments

• Routines may be offered free of charge or for a price set by the creator.
• A paid routine is a one-time purchase: once acquired, you retain access to it. Purchases are handled through the app store (e.g. Google Play Billing); Rhythm does not collect your payment card details.
• Creators set their own prices. The platform retains a service fee (5%) on paid sales; the remaining amount (95%) is attributed to the creator.
• Refunds. Digital content is generally non-refundable once delivered, except where required by law or the applicable app store's refund policy. To request a refund, contact the app store or reach us at the address in Section 12.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Publish content that is illegal, infringing, defamatory, harassing, deceptive, or otherwise harmful.
• Impersonate any person or entity, or misrepresent your affiliation.
• Attempt to gain unauthorized access to the Service, other users' accounts, or the underlying systems.
• Interfere with or disrupt the Service, its servers, or networks.
• Scrape, crawl, or otherwise extract data from the Service without our prior written consent.

6. Intellectual Property

The Service and its original content, features, and functionality (excluding user content) are owned by Rhythm and protected by applicable intellectual-property laws. You may not copy, modify, distribute, or create derivative works of the Service without our permission, except as expressly permitted by these Terms.

7. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any results or health, productivity, or lifestyle outcomes will be achieved from following any routine.

8. Limitation of Liability

To the maximum extent permitted by law, Rhythm and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to Rhythm, if any, in the twelve (12) months preceding the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, or for any other lawful reason, with or without notice. Upon termination, your right to use the Service ceases immediately; sections that by their nature should survive termination (including 6, 7, 8, and 11) will survive.

10. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms with a revised "Effective date." Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Rhythm operates, without regard to its conflict-of-law principles. Any dispute arising from these Terms shall be resolved in the courts of that jurisdiction, unless mandatory consumer-protection laws require otherwise.
